Supreme Court Filing: Army Sexual Assault Program Goes too Far

This afternoon we filed the attached Petition for Writ of Certiorari with the U.S Supreme Court. In the Petition, we challenge the Army'sSexual Harassment/Assault Response & Prevention ("SHARP") Program to the extent that it displaces the Constitutional due process rights our warriors should be afforded with a presumption of guilt. The SHARP Program prevents Army prosecutors and commanders from making solid, common-sense decisions as to whether a case should proceed. Combating sexual assault in the military is a laudable goal, to be sure, but we owe our warriors more than a knee-jerk reaction, based on political expediency, that supplants the presumption of innocence and other Constitutional due process guarantees.
